The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 (LARR) is an important legislation in India that governs the process of land acquisition for public purposes. This Act replaced the earlier Land Acquisition Act, 1894 and aimed to bring in more transparency, fairness, and accountability in the process of land acquisition.

One of the key features of the LARR Act is the requirement for obtaining consent of the affected families before acquiring their land. In case of land acquisition for public-private partnership projects, the consent of 80% of the affected families is required. In other cases, the consent of 70% of the affected families is required. This provision ensures that the interests of the landowners and the affected families are protected and that they are adequately compensated for the loss of their land.

Another important feature of the LARR Act is the provision for payment of compensation. The Act mandates payment of compensation at four times the market value in rural areas and twice the market value in urban areas. Additionally, the Act provides for payment of a solatium amount of 100% of the compensation amount. This provision ensures that the affected families receive fair compensation for the loss of their land.

The LARR Act also contains provisions for rehabilitation and resettlement of the affected families. The Act mandates that the affected families be provided with suitable alternative land, as well as monetary compensation for loss of livelihoods and other related expenses. This provision ensures that the affected families are not left destitute after losing their land and are able to rebuild their lives.

One of the most important provisions of the LARR Act is the requirement for social impact assessment (SIA) before acquiring land for public purposes. The SIA is a detailed study of the social, economic, and environmental impact of the project on the affected families and the local community. This provision ensures that the project does not cause any adverse impact on the lives of the affected families and the local community.

The LARR Act also contains provisions for grievance redressal. The Act mandates the establishment of a National Land Acquisition and Rehabilitation and Resettlement Authority to adjudicate disputes arising out of land acquisition. The Act also provides for a mechanism for appeals to be filed against the decisions of the Authority.

In conclusion, the LARR Act is an important legislation that seeks to bring in more transparency, fairness, and accountability in the process of land acquisition. The Act ensures that the interests of the affected families and the local community are protected, and that they receive fair compensation for the loss of their land.
