Section 3: Right to Information Act 2005

Article 19 of the Constitution of India enumerates freedom of speech and expression a fundamental right. The state cannot take away this right except on the grounds mentioned in Article 19(2). Right to Information is also a fundamental right because it is an essential part of the freedom of speech and expression.

Section 8: Right to Information Act 2005

Section 8 of the Right to Information Act exempts some information from its disclosure. The Public Information Officer (PIO) may refuse to disclose the information if it comes under any of the categories mentioned in section 8. The PIO may disclose the information if he thinks that its disclosure will serve the larger public interest.
