Question: Can a university take house rent from its employee? I am a regular employee of Baba Farid university. I am a nursing demonstrator. I have been pursuing my M.Sc. from Baba Farid university. I am residing in govt accommodation. As I am a student and I am not given a sixth pay commission but the University is asking me to pay house rent according to the new pay scale. I was not told earlier about the house rent hike.

You are a regular employee of Baba Farid University, hence, you have to pay the house rent allowance. In fact you are also pursuing a master degree in the same university but it does not entitle you to claim exemption. So the university can take house rent from its employee
So far as hike in house rent is concerned, the university cannot receive house rent as per the norms of sixth pay commission if the employee is getting fifth pay commission.
In Dhan Raj Gupta v. State of Haryana, 1997 SCC OnLine P&H 1725 the Punjab & Haryana High Court has held that if there is any hike in house rent the university must afford an opportunity of hearing to its employee before collecting house rent.
